Subletting your rental apartment can be practical when you temporarily work, study, or live in another location. In Sweden, a tenant normally needs the landlord's consent or permission from the Rent Tribunal before the subletting begins. You must also charge a fair rent, choose a suitable subtenant, and write a clear agreement. If the rules are not followed, you may risk losing the rental contract, even if the subtenant pays on time. This guide explains how to proceed, which documents you should keep, and what you can do if the landlord says no. The information applies to ordinary Swedish rental apartments and helps both first-hand tenants and people who rent out a room.

Permission for subletting

Under Chapter 12 of the Swedish Land Code, a tenant generally may not sublet the entire apartment without the landlord's consent or permission from the Rent Tribunal.[1] A valid reason may include temporary work or studies in another location, an extended stay abroad, or trying cohabitation. The reason should be genuine and the period should be limited.

Permission should be obtained before the subtenant moves in.

Send a written application to the landlord. State the reason, proposed dates, address, rent, and the name and contact details of the intended subtenant. Keep a copy of the application and any response.

  • Keep the lease, application, consent, and identity or reference documents in one place.
  • Do not let the subtenant move in before the required permission is granted.

When the landlord says no

If the landlord refuses, ask for the decision and the reasons in writing. You can apply to the Rent Tribunal for permission if you have a valid reason and the proposed subtenant is acceptable. Use the application form and provide supporting documents, such as an employment contract, study confirmation, travel information, or evidence of the planned period.

Do not assume that silence from the landlord means that the subletting is approved.

The Rent Tribunal assesses the circumstances individually. A refusal is not automatically unlawful, but a tenant should not give up without checking whether an application to the tribunal is possible. Follow the tribunal's instructions and meet every deadline.

Fair rent and extra costs

The rent must be reasonable in relation to the rent you pay for the apartment. If the apartment is furnished, a reasonable addition for furniture and equipment may be allowed. Charges for electricity, broadband, or other services should normally reflect the actual cost. A large unexplained markup can lead to a repayment claim and may create conflict with the subtenant.

  • Calculate the basic rent using the amount in your own lease.
  • List furniture, utilities, and other charges separately in the agreement.
  • Save receipts and payment records for the entire rental period.

The written sublease agreement

A written agreement reduces misunderstandings and makes it easier to prove what the parties decided. Include the apartment address, names, rental period, rent and payment date, deposit if any, furnishings, included services, notice period, and rules about damage and disturbance. The agreement with the subtenant does not remove your responsibility to the original landlord.

Read the agreement together and give each party a signed copy.

You remain responsible for rent, care of the apartment, and disturbances caused by the subtenant. Check the original lease before promising rights that you cannot grant, and never hand over your position in the tenancy as if the subtenant were the new first-hand tenant.

Roommates and lodgers

Having a lodger is different from subletting the whole apartment. A lodger normally shares the home with you, and this is often permitted without separate permission. However, you must still consider the size of the apartment, reasonable use, safety, and disturbance. If you move out and the other person effectively uses the whole apartment, the arrangement may instead be treated as a sublet.

If problems arise

Act quickly if rent is unpaid, the apartment is damaged, or neighbours report disturbances. Keep written records, communicate calmly, and follow the notice and termination rules that apply to the agreement. Do not change locks, remove belongings, or use threats to force someone out. For serious disputes, contact the Rent Tribunal or seek qualified advice. Enforcement matters may involve the Enforcement Authority.

  • Record dates, messages, payments, inspections, and reported damage.
  • Respect the occupant's privacy and arrange entry in advance unless an emergency applies.
  • Use the proper legal process if the occupant will not leave after a valid termination.

  2. Skicka en skriftlig ansökan till hyresvärden med period, skäl och uppgifter om den tilltänkta andrahandshyresgästen.
  3. När tillståndet är klart, skriv ett avtal som anger hyra, period, uppsägningstid, ansvar och vad som ingår.
  4. Fotografera lägenheten, gör en inventarielista och spara betalningsunderlag före inflyttningen.
